178. ALWAYS GIVE DOCUMENTS TO THE CLIENT – NOT TO AN INTERMEDIATOR

Courts have ruled that agents are at fault when the clients have not received documents, even if the agents gave the documents to someone who represented the clients, such as an attorney. If the attorney forgets to pass the documents on to the Buyer, the agent is at fault, not the attorney, unless the agent has received written instructions from the client to give documents to the attorney.

Whoever the intermediator is, – a relative, a son, a friend, an attorney, doesnt matter – always get authority from the client to give documents to these people. Without that written authority, make sure the client gets the documents – and get a receipt!
